What Is Consent to Establish (CTE)?

Before constructing or setting up any new industrial unit, expansion, or modernisation project in Maharashtra, businesses must obtain a Consent to Establish (CTE) from the Maharashtra Pollution Control Board (MPCB). This approval confirms that the proposed project meets environmental and pollution control norms before any physical construction begins.

CTE is mandated under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. Skipping this step can attract heavy penalties and forced closure of operations.

Who Needs a CTE?

  • New industrial units — manufacturing, processing, or storage facilities
  • Existing industries planning significant expansion or change in product mix
  • Infrastructure projects that generate trade effluents or air emissions
  • Real estate projects above a defined built-up area threshold

Industries are categorised as Red, Orange, Green, or White based on their pollution potential. Red category industries face the most stringent scrutiny.

Documents Required for CTE Application

  1. Duly filled online application on the MPCB portal (mpcb.gov.in)
  2. Project report detailing manufacturing process, raw materials, and products
  3. Site plan and layout drawing showing plot area, green belt, and effluent treatment facility
  4. Details of pollution control systems (ETP, STP, air pollution control equipment)
  5. Land ownership documents or lease agreement
  6. Environment Impact Assessment (EIA) report (for Category A and B projects)
  7. Consent fee challan (amount based on capital investment)

Step-by-Step Application Process

Step 1: Register on the MPCB Online Portal

Visit mpcb.gov.in and create an industry account. All applications are processed through MPCB's Integrated Online System to ensure transparency and faster turnaround.

Step 2: Fill in the Application Form

Provide complete details about your unit — type of industry, production capacity, water consumption, effluent generation, and stack emissions. Accuracy here is critical to avoid rejection.

Step 3: Upload Supporting Documents

Scan and upload all required documents in the prescribed format. Ensure that the site plan clearly marks effluent treatment plant (ETP) locations and green belt provisions.

Step 4: Pay the Consent Fee

Consent fees are determined based on the capital investment of the project and the pollution category. Payment can be made online through the portal.

Step 5: Site Inspection

For Red and Orange category industries, MPCB officers may conduct a site inspection before granting CTE. Cooperate fully and ensure that environmental safeguards are clearly communicated.

Step 6: Receipt of CTE

Once satisfied, MPCB issues the CTE electronically. This consent is typically valid for 5 years and must be displayed prominently at the project site.

Key Conditions Attached to CTE

  • Construction must begin within a stipulated period, failing which CTE lapses
  • Any change in product, capacity, or process requires fresh consent or amendment
  • Effluent treatment and pollution control systems must be installed as proposed
  • CTE does not substitute for other statutory clearances such as MoEFCC's Environmental Clearance

After CTE: Applying for Consent to Operate (CTO)

Once construction is complete and pollution control equipment is installed, you must apply for Consent to Operate (CTO) before commencing production. MPCB will verify that all conditions of the CTE have been fulfilled before granting CTO.

Common Reasons for CTE Rejection

  • Incomplete or inconsistent documentation
  • Site located in an ecologically sensitive or no-industry zone
  • Inadequate pollution control system design
  • Non-payment or incorrect consent fee

If your application is rejected, MPCB must provide written reasons. You can appeal to the Maharashtra Environment Appellate Authority within the prescribed timeframe.
